Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Vocabden mobile application, the MusicDen mobile application, the TranslateDen mobile application, the Vocabden browser extension, the Vocabden website, and related services (collectively, the "Service") provided by MD Teknoloji Bilişim ve Ticaret Anonim Şirketi ("Vocabden," "we," "us," or "our").

By downloading, accessing, or using any of these products, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. About the Service

The Service consists of the following products, all provided by MD Teknoloji Bilişim ve Ticaret Anonim Şirketi:

a. Vocabden

Vocabden is a language-learning application designed to help users learn English and German through stories, songs, listening exercises, flashcards, short educational video excerpts paired with vocabulary exercises, progress tracking, and AI-powered language analysis. The Vocabden browser extension lets you select text on a website or in video subtitles and receive an AI-powered analysis or translation that you can save to your vocabulary.

b. MusicDen

MusicDen is a language-learning application built around song games. You listen to a song, fill in its lyrics, look up words and phrases from the song, request songs to be added, and compare your scores with other players on leaderboards.

c. TranslateDen

TranslateDen is a translation application. It translates a word, a sentence or a paragraph between languages, shows what a tapped word means in its sentence, saves the words you look up and lets you review them with flashcards. TranslateDen also includes the Den keyboard, an optional keyboard you can enable in your phone's settings: when you tap Translate on it, the text you have selected or typed in the current text field is sent to our servers and replaced with its translation. The keyboard sends text only when you tap Translate.

d. One account for all products

Vocabden, MusicDen, TranslateDen and the browser extension use the same account and the same servers. Your saved words, learning progress and subscription are shared between them. Signing in to one product with an existing account signs you in to that same account; a second account is not created.

2. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under applicable law.

If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

3. Account Registration

Some features of the Service may require you to create an account.

MusicDen and TranslateDen can be used as a guest without creating an account. A guest account is tied to your device; if you lose the device or delete the app, guest data that has not been linked to an account may be lost. If you later create an account or sign in, your guest data is moved into that account.

You agree to:

• provide accurate, current, and complete information;
• keep your login credentials secure;
• be responsible for all activities under your account; and
• notify us promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.

You may not:

• copy, reproduce, distribute, or publicly display the Service except as expressly allowed;
• modify, adapt, reverse engineer, decompile, or attempt to extract source code, except where prohibited by law;
• use the Service for unlawful, abusive, or fraudulent purposes;
• interfere with the operation or security of the Service;
• scrape, crawl, or automatically extract data from the Service without permission.

5. Educational Purpose

Vocabden is provided for educational and informational purposes only. We do not guarantee fluency, exam results, employment outcomes, or any specific learning result from using the Service.

Your progress depends on many factors, including your study habits, consistency, and prior knowledge.

6. AI-Powered Features

Vocabden may include AI-powered tools that provide explanations, translations, contextual analysis, recommendations, and similar outputs.

You acknowledge and agree that:

• AI-generated content may sometimes be incomplete, inaccurate, or inappropriate;
• AI outputs are provided for general educational assistance only;
• you are responsible for reviewing and evaluating any AI-generated content before relying on it.

We may improve our AI features over time, and features may change, be limited, or be discontinued without notice.

7. User Content

You may be able to submit words, phrases, sentences, paragraphs to translate, responses, song requests, player names, feedback, or other content through the Service ("User Content").

Leaderboards: in MusicDen, the player name you enter and your score are shown to other users on the MusicDen and Vocabden leaderboards and on the music pages of our website. Choose a player name that does not reveal personal information. We may remove or rename player names that are offensive, misleading or that impersonate others.

You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, and use that content only as necessary to:

• operate the Service;
• provide requested features;
• improve performance, safety, and functionality; and
• comply with legal obligations.

You represent and warrant that:

• you own or have the necessary rights to submit the User Content;
• your User Content does not violate any law or third-party rights;
• your User Content does not contain unlawful, abusive, harmful, or infringing material.

8. Prohibited Conduct

You agree not to:

• use the Service in violation of any law or regulation;
• upload or submit content that is defamatory, threatening, hateful, obscene, or infringing;
• attempt to gain unauthorized access to accounts, systems, or networks;
• use bots, scripts, or automated methods to access the Service;
• exploit the Service for spam, phishing, or malicious activity;
• misuse song, story, educational video excerpt, or other content made available through the Service;
• manipulate game scores or leaderboards, or use a player name that is offensive, misleading, or impersonates another person;
• use the translation features or the Den keyboard to translate content that is unlawful or that you do not have the right to use.

We may investigate violations and take appropriate action, including suspension or termination of access.

9. Subscriptions and Paid Features

Some parts of the Service may be available only through a paid subscription or one-time purchase.

One subscription for all apps: a Lens, Plus or Pro subscription bought in Vocabden, MusicDen or TranslateDen is valid in all three apps and in the browser extension, because they share one account. You do not need to buy a separate subscription for each app. Some paid features include a monthly usage allowance for AI and translation requests; when the allowance of your plan is used up, those features pause until the allowance renews with your billing period, while the rest of the Service keeps working.

If you purchase a subscription through Apple or Google Play:

• payment will be charged through your Apple account or your Google Play account;
• subscriptions may renew automatically unless cancelled before the renewal date;
• billing, renewal, and cancellation are managed by Apple or Google under the subscription settings of the store where you bought it.

We may change pricing, available plans, features, or subscription offerings at any time to the extent permitted by applicable law.

Unless required by applicable law, all purchases are final and non-refundable once processed. Refund requests for purchases made through Apple or Google Play are handled solely by Apple or Google in accordance with their policies. Cancelling a subscription stops future renewals only and does not entitle the user to a refund for the current billing period, unless otherwise required by law.

10. Free Trials and Promotional Offers

We may offer free trials, discounts, promotional pricing, or limited-time access to certain features.

Unless otherwise stated:

• eligibility for promotional offers is determined by us or the relevant platform provider;
• we may modify or end promotions at any time;
• after a free trial ends, the applicable paid subscription may begin automatically unless cancelled in time.

11. Intellectual Property

The Service, including its design, software, text, graphics, logos, audio, features, and content made available by us, is owned by or licensed to MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not use our intellectual property without prior written consent.

All trademarks, service marks, and trade names are the property of their respective owners.

12. Third-Party Services

The Service may rely on or integrate third-party services, including but not limited to:

• Firebase
• RevenueCat
• OneSignal
• OpenAI
• Sentry
• DigitalOcean
• Mixpanel
• YouTube (Google LLC)
• Musixmatch
• Cloudflare

Song lyrics displayed in Vocabden and MusicDen are provided by Musixmatch. The lyrics are owned by their respective songwriters, publishers and other rights holders, and your use of them is limited to personal, non-commercial language learning within the Service. You may not copy, extract, redistribute or commercially exploit lyrics from the Service.

We are not responsible for third-party services, websites, products, or policies. Your use of third-party services may also be subject to their own terms and privacy policies.

13. YouTube Content

Vocabden and MusicDen embed video content from YouTube, including the music videos in MusicDen, using the YouTube iframe embed feature provided by Google LLC. By using features of the Service that display YouTube videos, you acknowledge and agree to the following:

a. Compliance with YouTube Terms

Your access to and use of YouTube videos embedded within the Service is subject to the YouTube Terms of Service and Google's Privacy Policy. By using YouTube-enabled features in Vocabden or MusicDen, you also agree to be bound by the YouTube Terms of Service.

b. Content Ownership

All video content accessed through YouTube is owned by YouTube (Google LLC) and/or the respective content creators. Vocabden does not claim any ownership or rights over YouTube video content. All trademarks, service marks, and other intellectual property rights in YouTube content remain with their respective owners.

c. Prohibited Actions

When accessing YouTube content through the Service, you may not:

• download, copy, screen-record, or locally store any YouTube video content;
• redistribute, publicly perform, or commercially exploit any YouTube video content;
• attempt to circumvent any technological measures or restrictions applied by YouTube or Google to video content;
• use the embedded player in any way that violates the YouTube Terms of Service.

d. Content Availability

YouTube videos embedded in the Service may become unavailable at any time due to removal by the content owner, changes in YouTube's platform, geographic restrictions, or any other reason outside our control. Vocabden is not responsible for the unavailability of any YouTube content and does not guarantee that any specific video will remain accessible.

e. No Endorsement

The availability of YouTube videos within Vocabden does not constitute an endorsement of the content, the content creator, or any views or opinions expressed in those videos.

14. Educational Video Excerpts

Vocabden includes brief audiovisual excerpts from third-party media content as part of its language learning features. By using features of the Service that display educational video excerpts, you acknowledge and agree to the following:

a. Purpose and Educational Use

The Service may include brief audiovisual excerpts from third-party film, television, and other media content, each typically lasting only a few seconds. These excerpts are used exclusively for educational and language learning purposes. Each excerpt is paired with interactive vocabulary exercises (such as multiple-choice and word unscramble activities) that transform the viewing experience into an active learning exercise. The use of these excerpts is intended to illustrate real-world language usage in authentic contexts, supporting vocabulary acquisition, listening comprehension, and contextual language understanding. Vocabden does not provide these excerpts for entertainment viewing or as a substitute for the original works.

b. Content Ownership and Attribution

All audiovisual content presented as educational excerpts is owned by and remains the intellectual property of the original rights holders, including production companies, studios, distributors, and other copyright owners. Vocabden does not claim any ownership, license, or rights over the underlying audiovisual content. All trademarks, service marks, copyrights, and other intellectual property rights in the original content remain with their respective owners. The inclusion of any excerpt does not imply any affiliation with, endorsement by, or licensing arrangement with the original rights holders.

c. Transformative Educational Use

Vocabden's use of brief audiovisual excerpts is educational and transformative in nature. Original content is significantly recontextualized: excerpts are short (typically a few seconds), are paired with interactive language exercises, are integrated into a spaced repetition learning system, and serve a fundamentally different purpose than the original works. Vocabden uses only the minimum amount of content necessary to provide meaningful language learning context. This use is not intended to serve as a substitute for the original works, and does not diminish the market for or value of the original content.

d. DMCA Compliance and Content Removal

Vocabden respects the intellectual property rights of others and complies with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA) where applicable. If you are a copyright owner or authorized agent and believe that content available through the Service infringes your copyright, you may submit a takedown notice to: [email protected]

A valid takedown notice should include:

• identification of the copyrighted work claimed to have been infringed;
• identification of the allegedly infringing material with sufficient detail to locate it;
• your contact information (name, address, telephone number, and email address);
• a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
• a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner;
• your physical or electronic signature.

Upon receipt of a valid takedown notice, we will promptly remove or disable access to the identified content and make reasonable efforts to notify the user, if applicable. Vocabden may also remove or disable content at its sole discretion if it determines that removal is appropriate.

e. Prohibited Actions

When accessing educational video excerpts through the Service, you may not:

• download, copy, screen-record, or locally store any educational video excerpt;
• redistribute, share, publicly perform, or commercially exploit any video content from the Service;
• extract, rip, or otherwise separate video content from the Service's educational context;
• use any automated means to access, capture, or reproduce video content;
• circumvent any technological measures applied to video content delivery.

f. Content Availability

Educational video excerpts may be modified, replaced, or removed at any time without notice. Removal may occur due to rights holder requests, licensing changes, legal requirements, or at Vocabden's discretion. Vocabden does not guarantee that any specific excerpt will remain available. Vocabden may modify the selection, duration, or presentation of excerpts at any time.

g. No Endorsement

The inclusion of any audiovisual excerpt does not constitute an endorsement of the content, the original work, or any views, opinions, products, or services depicted. Educational excerpts are selected solely for their language learning value.

15. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using any product of the Service, you acknowledge that we may collect, use, and process data as described in the Privacy Policy.

16. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We may perform maintenance, updates, bug fixes, or changes that temporarily affect access.

17. Termination

We may suspend or terminate your access to the Service, with or without notice, if:

• you violate these Terms;
• we suspect fraud, abuse, or unlawful activity;
• your use of the Service creates risk or harm for us, other users, or third parties.

You may stop using the Service at any time. You can delete your account from the account page in Vocabden, MusicDen or TranslateDen, or request account deletion by contacting us at [email protected]. Because the products share one account, deleting it removes your data from all of them.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and dispute-related provisions.

18. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that:

• the Service will meet your expectations or requirements;
• the Service will be uninterrupted, error-free, or secure;
• content or AI-generated outputs will always be accurate, complete, or reliable.

19. Limitation of Liability

To the maximum extent permitted by law, MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and its directors, officers, employees, affiliates, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Service.

To the extent liability cannot be excluded, our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us for the Service during the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater.

20. Indemnification

You agree to defend, indemnify, and hold harmless MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and its affiliates, officers, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the Service;
• your violation of these Terms;
• your violation of any law or third-party right;
• your User Content.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles.

22. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved amicably by contacting us at [email protected].

If no amicable resolution is reached, disputes shall be subject to the jurisdiction of the courts and enforcement offices of Tokat, Türkiye, unless mandatory law requires otherwise.

23. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above.

If changes are material, we may provide additional notice through the Service or our website. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
